Labbe Tries To Resign, Yates Would Not Have It

According to Ryan Smithson, for NASCAR.COM, Dale Jarrett’s crew chief Slugger Labbe tried to resign to make things easier on Robert Yates Racing in light of recent penalties imposed on the #88 team.[thumb:348:l:s=1:l=x]

Detailed in the article was Yates’ firm support for Labbe, and they are appealing the penalties to Nascar. Since the appeal is in progress, and will not be heard until the middle of next week, Slugger was allowed to attend the event at Darlington this week.

Reported is that the sway bar infraction in question lies in one of those gray area’s of the Nascar rulebook. There wasn’t an attempt to hide the modification from Nascar, and it was common knowledge throughout the team about the mounting of the bar.

What this brings to light is a similar instance back in September where both Jimmie Johnson and Kyle Busch’s car height was brought into question. The result was a modified shock package that also was in the gray area of the Nascar rulebook. In that case there weren’t any penalties levied, but shortly thereafter Nascar issued an immediate rule change in regards to shocks.

Now, in what can be presented as a similar situation, the #88 team is being penalized. Is this fair and equal treatment under similar circumstances?

In Nascar’s eyes, up to now, yes it is. While the modification is in a gray area, Nascar firmly believes that the intent of the swaybar was to circumvent the shock rules that were put into place.

Needless to say, there’s two sides to every coin. We’ll see what the outcome of the appeal is next week, and see if it changes any.
